At Errand Angels we connect people with the best of their neighborhoods by enabling businesses to meet consumers’ needs of ease and convenience, and, in turn, generate new ways for people to earn, work, and live. 

This Privacy Policy (“Policy”) describes how Errand Angels , Inc. and its affiliates (“Errand Angels ”, “we”, “our”, or “us”) collect, process, retain, and disclose your Personal Information when providing its services, including, but not limited to, its consumer platforms, websites, and mobile applications, any website, platform or application that contains or includes a link to this Policy, and channels of communication (collectively the “Services”). 

This Policy does not apply to other contractors, or to the personnel of Merchants and Vendors, which are subject to separate privacy policies. 

What Personal Information does Errand Angels collect or process?

Personal Information is any information that Errand Angels can reasonably use to identify you, whether that information identifies you on its own or when combined with other information. Anonymous information and information that has been de-identified such that it cannot identify you is not Personal Information.

We may process the following categories of Personal Information in connection with our Services:

• Contact Information, which includes your name, various addresses (home, work, or other delivery locations), email addresses, phone numbers, and any other contact details you provide to us. 
• Account and Profile Information, encompassing your username, credentials, privacy settings, notification preferences, photos, and other details you include in your Errand Angels profile, along with identifiers we may associate with an account and data received from third-party platforms or authentication services connected to our Services. 
• Identification Documents and Signature for Age-Restricted Products, such as a driver's license or other government-issued ID, which we may handle in specific situations like when ordering age-restricted items (like alcohol) or products that necessitate age and/or identity verification for legal and regulatory adherence.
• Communications with Errand Angels encompass the content of in-app messages, SMS/text messages, chats, phone calls, and emails related to our services, including customer support inquiries and outreach. This includes the date and time of communications, the method or channel used, any call recordings (if applicable), and the outcomes, actions, and/or resolutions from these communications, along with other relevant information. 
• You also provide content that you create or share, such as reviews about experiences on our platform, ratings of employees who deliver services or merchants you order from, and any photos you upload.
• Regarding Payment Information, this includes credit or debit card details and information about the payment methods and services (like PayPal or Venmo) used for purchases through our Services. While payment information is primarily stored and processed by our third-party service providers, including payment processors, we may retain and process limited payment-related information, such as the last four digits of a payment card, the name of the issuing financial institution, and the payment service used.
• Activities and transactions involving our Services include details about the type of service and products ordered, order history, cart contents, special order instructions (such as dietary or delivery preferences), transaction totals, gift cards purchased, features and functionalities engaged with, survey responses or market research participation, promotional involvement, and photos or videos related to your activities and transactions with our Services, including our referral program and other special initiatives (including information about those who have sent or received gifts or referrals). Device Information encompasses data about the computers, phones, and other devices used to access Errand Angels or our Services, such as internet protocol addresses, device-specific identifiers, operating systems and versions, preferred languages, hardware model identifiers, browser types and settings, and other device-related information. Some of the information you choose to provide us, specifically government-issued identification and your signature, is received when we verify age and identity, as well as the authenticity of a submitted government-issued ID for certain orders (such as alcohol orders) to prevent fraud and ensure legal and regulatory compliance. 
• We also receive precise location information to facilitate deliveries and enable certain content, features, and functionality within our Services. We do not use any sensitive Personal Information for purposes other than those reasonably expected by an average consumer to provide our Services, or for legal, security, and safety purposes, and not for the purpose of inferring characteristics about an individual. When we process de-identified information, we maintain and use the information in its de-identified form and do not attempt to re-identify the information, except as permitted by applicable law.

III. How does Errand Angels collect or receive Personal Information?

• From Users of Our Services: We collect information from users of our Services during activities like account creation and updates, order placement, survey participation, promotions or contests, content creation or posting (photos, reviews), communication with us, or enrollment in additional services or programs (e.g., referral or gift programs). When users provide Personal Information about others, such as for our referral or gift programs, they affirm they have the necessary rights and permissions to share that information with us.
• Automatically Through Our Services: Our Services automatically gather certain Personal Information from your device and browser when you use them.
• Through Cookies and Similar Technologies: Cookies, small text files placed on your device typically via your browser, record information like settings. Our Services, including our website, may receive information about you through cookies or similar technologies (e.g., pixels, software development kits), depending on your settings.
• From Our Service Providers: We collect Personal Information from service providers we engage to perform services on our behalf. This includes providers of communication (such as email and SMS/text messaging), payment processing (like PayPal and Venmo), market research, promotions, contests, gift card programs, and services related to marketing, advertising, analytics, security, fraud, identity, and age verification.
• From Legal Claims, Disputes, Requests, and Orders: We may gather Personal Information from various third parties or individuals involved in legal matters, including law enforcement agencies, government entities, both users and non-users of our Services, and any other parties connected to the issue.

IV. Utilization of Personal Information by Errand Angels

Errand Angels may use your Personal Information (as outlined in Section II) depending on the Services you select and your interactions with us:

•  To Provide and Personalize Errand Angels Services, which includes enabling you to place and pay for orders and requests, facilitating the orders and requests made through our Services, allowing participation in promotions and contests, offering promotions, special deals, and opportunities, permitting the purchase/order of our gift cards, showcasing publicly posted reviews, photos, and other content, and personalizing your experience based on preferences, location, and past usage.
• To Offer Customer Support, which involves exchanging communications, investigating, analyzing, and resolving issues related to order delivery, service fulfillment, and employee performance, assessing and enhancing our customer support, and ensuring issues are addressed according to our internal standards, processes, requirements, and applicable laws.
• To Develop, Analyze, and Enhance our Services, by debugging or troubleshooting, understanding usage and preferences of you and other customers, improving and creating new Services or initiatives for the best possible user experience.
• To Market and Promote Errand Angels and our Services, by displaying advertisements on our Services and third-party sites, refining and executing marketing campaigns, evaluating the effectiveness of our advertising, and presenting the most relevant ads about Errand Angels
• To allow and facilitate communication with Errand Angels, including discussions about our services, updates, orders, account changes, terms, and policies, and to enable communications with Errand Angels.
• For authentication, integrity, security, quality, and safety, this includes verifying your account and identity as applicable to our services, providing a secure payment and shopping experience, detecting, investigating, and preventing malicious or illegal conduct, bugs, malware, fraudulent activities, illegal or unsafe experiences (such as ensuring age-restricted orders are delivered to the intended recipient), and taking any other actions we deem necessary to protect your safety and security, as well as that of others, property, and businesses, and to secure our services.
• For legal reasons and policy compliance, this includes complying with our obligations under applicable law, responding to valid legal processes (e.g., requests or orders from law enforcement, courts, regulators, and other government agencies), participating in civil discovery, litigation, or other adversarial legal proceedings, enforcing or investigating potential or actual violations of our terms, policies, or other legal agreements, investigating, monitoring, or mitigating any actual or alleged illegal activities in connection with our services, complying with tax obligations, performing audits and assessments, and enabling you to exercise your rights as legally required.

V. Disclosure of Personal Information by Errand Angels.

Errand Angels may disclose Personal Information (as detailed in Section II) depending on the services you utilize or interact with.

• To Service Providers: We may share Personal Information with our service providers and vendors to fulfill our business operations and perform our Services. This includes providers of identification and verification, cloud, payment, gift card program, auditing, security, marketing and advertising, promotions, sweepstakes, contests, market research, communication, analytics, location and mapping, and customer support services.

This includes the recipient's name, address, location details, telephone number, order details (which may include purchased product information), and any special or delivery instructions.

This advertising may be personalized based on your interaction with our Services and your activities on third-party services.

• Regarding Actual or Potential Corporate Transactions: In the event of strategic transactions, such as sales, mergers, acquisitions, joint ventures, assignments, transfers, reorganizations, bankruptcies, or receiverships, we may disclose your Personal Information and other relevant information during the due diligence process to counterparties and those assisting with the transaction. This information may be transferred to a successor or affiliate as part of the transaction, along with other assets.

Errand Angels will not discriminate against you for exercising any of your rights. We may deny requests if we cannot verify your identity or if an exemption or exception applies.

• Promotional emails include an opt-out option at the bottom; simply select 'Unsubscribe.'
• After unsubscribing, you may choose to deactivate your preferred options (e.g., Errand Angels Offers).
• To opt-out of marketing SMS, text 'STOP' in response to any marketing SMS.
• To opt-out of all transactional SMS, text 'STOP' in response to a transactional SMS.
• If you want to stop receiving all communications from us, you must delete your account. 

1. Collection of Consumer Health Data

We gather Personal Information as outlined in Section II (Personal Information Collection and Processing by Errand Angels) of this Policy. This may encompass Consumer Health Data regarding yourself or individuals on whose behalf you make purchases:

Allergies or other conditions: When utilizing our Services to order specific products (such as food), you have the option to use free-text fields for special instructions. Within these fields, you might reveal details that could reflect health conditions (for instance, allergies or other medical conditions).

• Product Purchase Information: Your history of purchasing health-related products through our Services may reveal details about your health status. This includes, but is not limited to, items such as contraceptives, at-home diagnostic tests, and diabetic testing supplies. 
• Activities on or with our Services: We may gather information indicative of health status when you interact with our Services. This can occur when you add health-related products to your cart, search for, browse, or engage with health-related products, interact with related content, features, functionality, or programs, or submit photos or videos of health-related products to us or through our Services. 
• When processing de-identified information, we retain and utilize the data in its de-identified state and do not attempt to re-identify it.

• We obtain Personal Information as described in Section III (How Errand Angels collect or receive Personal Information) of this Policy, which includes sourcing Consumer Health Data from the listed sources.
• Through your use of our Services: We may collect Consumer Health Data about you or someone for whom you are purchasing when you place an order through our Services (e.g., consumer platforms) that involves Consumer Health Data and during your interactions with our Services.
• By an Errand Angels Account Holder on your behalf: We may collect Consumer Health Data about you when an Errand Angels account holder places an order on your behalf using our Services, although we may not be aware that this information pertains to you.
• Directly from you during communication: We may collect Consumer Health Data about you when you provide it to us or engage in communication with us, such as when you submit a customer support inquiry, request, or communication.
• 3. Purposes for Collecting and Using Consumer Health Data.
• We utilize your Personal Information as outlined in Section IV (Usage of Personal Information by Errand Angels) of this Policy, and Consumer Health Data may be utilized accordingly.
• To provide Errand Angels Services, which includes, but is not limited to, enabling you to place and pay for orders and service requests, facilitating the orders you place through our Services (this involves transmitting Consumer Health Data to Merchants and Errand Angels' employees), as well as offering recommendations and promotions to you via our Services. To offer Customer Support, this encompasses exchanging communications, investigating, analyzing, and resolving support issues, assessing and enhancing our customer support, and ensuring that support issues are handled according to our internal standards, procedures, and requirements, as well as in compliance with applicable laws.
• To develop, analyze, and improve our services, we engage in debugging or troubleshooting, understanding how you and other customers use our services and your preferences, enhancing the services, and creating new services or initiatives to provide our users with the best possible experience. 
• For integrity, security, quality, and safety, we detect, investigate, and prevent malicious or illegal conduct, bugs, malware, fraudulent activity, illegal or unsafe experiences, and take any other actions necessary to protect your safety and security, as well as that of other individuals, property, and businesses, and to secure our services.
• For legal reasons and policy compliance, we adhere to our obligations under applicable law and respond to valid legal processes (e.g., requests or orders from law enforcement, courts, regulators, and other government agencies), participate in civil discovery, litigation, or other legal proceedings, enforce or investigate potential or actual violations of our terms, policies, or other legal agreements, investigate, monitor or mitigate actual or alleged illegal activities in connection with our services, perform audits and assessments, and enable you to exercise your rights as legally required.

4. Sharing of Consumer Health Data.

Your Personal Information may be shared as outlined in Section V (Disclosure of Personal Information by Errand Angels) of this Policy, and your Consumer Health Data may be shared in the following manner:

• To Errand Angels Employees: Consumer Health Data may be disclosed to Dashers to facilitate order delivery, which can include your name (e.g., first name and last initial), delivery address, order details (potentially including purchased products), and user instructions (such as special or delivery instructions).
• To Merchants: Consumer Health Data may be shared with Merchants in relation to your orders or Services, including your name (e.g., first name and last initial, or full name), delivery address (if the Merchant is handling delivery), and order details (such as purchased products, allergies, special instructions, or other delivery instructions).
• To Service Providers: Consumer Health Data may be disclosed to our service providers to meet business requirements and deliver our Services, encompassing data sharing with cloud and IT services, payment processors, communication services, customer support, safety, fraud and security services, and audit firms.
• To Government Authorities or as Legally Required or Permitted: We and our service providers (both domestic and international) may disclose your Consumer Health Data, including purchase details from our consumer platforms, to entities like government authorities, industry counterparts, or other third parties as legally mandated or allowed, or when necessary to enforce our agreements, deter fraud, or safeguard the rights, property, or safety of our business, employees, merchants, customers, or others. Such disclosures may involve lawful requests from US or foreign courts, law enforcement, or other government bodies.
• For Actual or Potential Corporate Transactions: In the event of strategic transactions such as sales, mergers, acquisitions, joint ventures, assignments, transfers, reorganizations, bankruptcies, or receiverships, we may disclose your Consumer Health Data and other information during the due diligence process to counterparties and those assisting with the transaction. This data may also be transferred to a successor or affiliate as part of the transaction, along with other assets.
• Other Third Parties or Persons: We may share or provide your Consumer Health Data to other third parties or individuals, for instance, with your consent or at your instruction, which includes, but is not limited to, situations where you link third-party accounts to your account with us.

Errand Angels will not discriminate against you for exercising any of your rights. Subject to certain exceptions, exemptions, and restrictions, you may have the privacy rights outlined in Section VI (Your Privacy Rights and Choices) of this Policy. Access: You may have the right to request access to your Consumer Health Data and receive it in a portable and machine-readable format.

Deletion: You may have the right to request the deletion of your Consumer Health Data.

Right to Withdraw Consent: You have the right to withdraw consent to any collection or sharing of Consumer Health Data.

Exercising Rights:

If you have an Errand Angels account, you can exercise some of your rights directly through your account (e.g., access, deletion, and correction).

VIII. Security and Retention.

We employ commercially reasonable administrative, organizational, technical, and physical security measures to protect your Personal Information from unauthorized access, modification, disclosure, or destruction. However, we cannot guarantee the security of your Personal Information, as no Internet or email transmission is ever completely secure or error-free. You should be careful about the information you send to us via our Services or when communicating with us via email, SMS/texts, chat, or other communication methods. We are not liable for the circumvention of any privacy settings or security measures on our Services or third-party websites. It is also your responsibility to protect your Personal Information, and we recommend that you take appropriate precautions. If you believe that your Errand Angels account or interaction with us is no longer secure, please immediately notify Errand Angels support or as indicated below. 

XI. Third-Party Sites

Our Services may provide links to third-party websites not under the control of Errand Angels, such as when signing up for a loyalty card on a Merchant's website. These third parties are beyond our control, and we are not liable for their privacy policies or practices. Should you provide any Personal Information to a third party or via such third-party websites, it will be governed by the privacy policies and practices of that third party.
